Sending a Quashed Decision Back to the Initial Decision-maker Caused a Reasonable Apprehension of Bias

The long title explains the result in Conseil des montagnais de Natashquan c. Malec, 2012 CF 1392, a case about alleged discrimination against Aboriginal educators.

An initial decision unfavourable to the applicant was made, but quashed on judicial review. It was sent back to the Canadian Human Rights Tribunal for re-decision. The President sent it back to the initial decision-maker.

Wrongly so, held Justice Noël on this application for judicial review. The initial decision had been struck down for serious failures to consider relevant evidence. Accordingly, the reasonable observer would not be confident in the impartiality of the decision-maker the second time around.

Here is a description of the flaws in the initial decision:
[32]           La juge Tremblay-Lamer conclut que la décision du membre instructeur Doucet est déraisonnable. Les reproches sont importants. Elle considéra comme étant « fausse » l’affirmation selon laquelle l’employeur n’avait fourni aucune preuve justifiant la politique d’éloignement. La juge déclara que le membre instructeur avait omis, « sans motifs valables », d’accorder une quelconque force probante à l’admission d’un témoin lors d’un contre-interrogatoire. Elle reproche au décideur, en plus, de ne pas avoir examiné le témoignage d’un autre témoin concernant la prime d’éloignement. Enfin, la juge reproche au membre instructeur de ne pas avoir pris en considération « l’ensemble des témoignages ».
This was not, Justice Noël emphasized, like a breach of procedural fairness which had caused a failure to consider all the evidence (at para. 40). The failure here was held to go much further, right to the heart of the decision. Thus the President was wrong to have sent the file back to the initial decision-maker:
[42]           Une personne bien renseignée, qui connaît les enjeux, ayant pris en considération la décision du membre instructeur, les motifs et le jugement de la juge Tremblay-Lamer, lequel inclut les reproches constatés et le travail à être entrepris, la décision de la présidente du Tribunal assignant à nouveau le dossier au même membre instructeur ne peut que conclure, selon toute vraisemblance que le décideur consciemment ou non, ne rendra pas une décision juste.
Justice Noël also emphasized the particular nature of the decisions which remained to be taken, which perhaps limits the precedential force of this judgment (see e.g. para. 46).
